By the way, I don't remember there are rules about plagiarism for banners. So as far as I know two clans can have the same banner.

You can't have sole rights on a banner. You can only hope that others won't use it.
Good thing is that people usually know who had a banner first, meaning you will have the approval of the majority and whoever copies it will not.

Either way, it can't be fun to have a non exclusive banner as "exclusive banner".
