I have been getting this really strange error that is getting really annoying, the same two frames keep playing over and over again yet when I alt + tab out and back in the problem is all resolved but I am usually dead.
Graphics card: HD 5770
CPU: x3 450
Ram: 4gb
OS: Xp 32
Mobo: M3A770De
I have already tried reformating just incase it was an old conflict but to no avail.
Any suggestions?

Then, I suggest to modify the buffer size.
The file you need to open is in your documents in Warband Folder; It's called rlg_config.
Open it and search for this line:
Render_Buffer_Size
15 is the default setting, this caused problems for some users.
Try to set the Buffer Size first to 50% of your VGA RAM. If the problem persists, increase it to 75%.
Also, you can always try the game in DX7, and make sure you don't have Load textures on demand feature enabled.
You can always try increasing the VGA fan RPM to 80% via a tuner software, I suggest EVGA Precision. Overclocking of the Video Card is not recommended.
If the problem still persists, write down your computer specs, so I can think about it further.

This is only in CRPG though, native seems ok.
I increased the buffer size to 60, but as Digglez say does 60 mean MB or percent?

60 means 60mb. I have 1024 mb of VRAM so I set the buffer size to 512.
I had this problem until I tried lowering the texture size like crazy and it solved everything (I set it to minimum). You can leave everything else as it is and first of all keep using DX9. DX7 is barely playable. The game doesn't look as good with minimum textures but meh I don't give a fuck... Disabling particle systems also helps.
If you want to keep your graphics quality, the best thing to do is to install win 7 64 bits.
