Title: is it possible my pc is being hijacked from time to time?

so I just got sued for sharing a movie on bittorent for about ten minutes around 5am about a month ago. 

Now I always have my PC on that energysaving mode over night,  and sometimes it jumps back on and runs all night. 

Which makes me wonder,  if my pc has some sort of infestation and is being used remotely by others? is dat possibru?

Hijacking pc's is not always about stealing data and stuff they often just wanna use it as a spam machine or stuff like that, sounds absolutely possible. I always turn my stuff off, after reading your story I'll also pull out the lan plug  :|

Have you ran malewarebytes or spybot or anything else to check your system? If not, do so now.

Wait guys, what if my pc is turned off but the router runs 24/7. They can't hijack my pc, but could they hijack my "internet" or ip through the router? If that makes any sense  :?

I watch porn on ur router every night when ur pc is turned off

check scheduled events such as the search for updatings, some programs put them at 3-5 nights

Is your hard drive backed up to a time before you noticed possible indicators of an intrusion? Do you know your PC well enough to spot abnormal processes or network activity?

WarLord, leaving your router on does leave you open to a possible attack. Especially if UPnP is on, I think.

This would be my bet. Could be part of Windows or GPU driver or flash auto-checking for updates. Can happen with any OS, but Windows 8 has a bunch of programs that will check updates every time you plug your laptop into a power source or multiple times a day. Even if you set it to check once a week or never. They can be disabled, but it's a bitch compared to checking one box and having the program fuck off.

If you actually power down your computer instead of putting it into sleep/hibernate mode, nothing is going to start it up in the middle of the night. Unless the hacker is living in your closet and they come out at night to turn your computer on lol

^ This is the most likely cause. Hijackers do exist of course, but I've never heard of anyone who had a real life "Omg somebody else is controlling my pc from afar" Hollywood-esque scenario. I used to joke that my laptop was haunted since it would boot up in the early am hours while I was asleep relatively often, however I forgot that I was merely putting it to sleep all the time and not shutting it down completely. Turned out that I had a program that regularly updated at 3am. Also, if you ever have those "You must restart your computer to completely finish installing windows updates" pop-ups that start a 15 minute countdown until your system restarts, and you click "remind me in 4 hours" and then forget about it... well, if you put your pc to sleep, 4 hours can pass and then your pc seemingly "wakes up on its own."

Also, to avoid sharing things on torrent programs, I always uninstall bittorrent after I use it to download something, otherwise it is almost always running in the background and sucking up my internet speed/connecting to who-knows-what across the internet. I've got the installer downloaded and saved to my pc, so whenever I want to get another torrent re-installing the program takes me no more than 20 seconds.

Also, they might have the wrong IP. Fight it.
The methods with which they gather those IPs on Torrents are far from fail-free.

Read up on the subject and look for an IT specialized lawyer.
Normally they take like  €200 to avoid for you paying €800 or something. That's the route I took when I had the same problem...

It is possible. I remember when I still worked at an ISP we had a call from police about a phishing webpage being hosted on one of our client's IP. It turned out the client was actually some inept granny and she had her shit hijacked, so they basically used her to host it lmfao :lol:

Turns out the night it happened I  had a friend and his wife stay at my place while I was at my gf's.

Fun fact he is a lawyer himself naughty bastard hehe.

My outgoing traffic few terabytes per month, and it's a given that I Seeding only if I pirate something ^^ sure rightsholders do not like Russia )) And its pretty save for common ppls.

Might want to run a virus scan and separately check for rootkits

I used to joke that my laptop was haunted since it would boot up in the early am hours while I was asleep relatively often, however I forgot that I was merely putting it to sleep all the time and not shutting it down completely.

I used to get this but I never use sleep on my PC I turn it off fully. Turned out the power button wasn't working properly and was just turning itself on. I got a new case a few months later and all was well.
